I think the issue was by ths following , I read about AJAX and getting calls from it and Im trying to restructure code, to get work. , Try
code :
$('.login').submit(function(e) {

e.preventDefault();
var error = 0;

var email = $email.val();

// function that makes a request and returns a promise:
function testAjax() {
    return $.ajax({
        url: 'MY URL',
        data: {
        'email': email
        },
        type: 'POST',
    });
}
var error = 0;
var promise = testAjax();
function displayData(x) {
   return x.then(function(realData) {
        if (realData == 1) {
            createErrTult("Błąd! taki email już istnieje w bazie!", $email)

//THAT VARIABLE IS STILL NOT WORKING OUTSIDE AJAX
            error++;
        }
    }, function(jqxhr, textStatus, errorThrown) {
       console.log(errorThrown)
    });
};
displayData(promise).then(function(data) {
     // if (error !=0 ) return;
     // evaluate `error` status here ,
     // do stuff
});
function test() {
  return $.ajax("https://gist.githubusercontent.com/guest271314/6a76aa9d2921350c9d53/raw/49fbc054731540fa68b565e398d3574fde7366e9/abc.txt")
};
var error = 0;
var promise = test();
function displayData(x) {
   return x.then(function(realData) {
       if (realData) {
            console.log("Błąd! taki email już istnieje w bazie!")

//THAT VARIABLE IS STILL NOT WORKING OUTSIDE AJAX
            error++;
        }
    }, function(jqxhr, textStatus, errorThrown) {
       console.log(errorThrown)
    });
};
displayData(promise).then(function(data) {
  if (error !== 0)
  console.log(error)
})

hope this fix your issue Look at the jQuery promise/deferred objects, they allow you to control this exact behavior.
code :
$.when( $.ajax("test.aspx") ).then( $.ajax("test2.aspx") );

This might help you I am trying to implement country search in my dummy application. Initially on home page i am using list view and it is displaying properly. But the same list view, if i am displaying using ajax, List view content is displaying but css is not applied on this. , in first load your Html is:
code :
<ul data-divider-theme="b" data-theme="d" data-filter-theme="d" data-filter-placeholder="Search Country/Group..." data-filter="true" data-role="listview"
    class="ui-listview">
    <li data-role="list-divider" role="heading" class="ui-li ui-li-divider ui-bar-b">
        A
    </li>
    <li data-icon="false" data-corners="false" data-shadow="false" data-iconshadow="true" data-wrapperels="div" data-iconpos="right" data-theme="d"
        class="ui-btn ui-btn-icon-right ui-li ui-btn-up-d">
        <div class="ui-btn-inner ui-li">
            <div class="ui-btn-text">
                <a href="#" class="ui-link-inherit">Afghanistan</a></div>
        </div>
    </li>

I wish this helpful for you Why are you chaining empty() and $.each ? It doesn't make sense to chain them in this particular example.
code :
$('#teamid').empty().each(json, function (value, key) {
     $('#teamid').append($("<option></option>").attr("value", value).text(key));
 });
  $('#teamid').empty();
  $.each(json, function (value, key) {
      $('#teamid').append($("<option></option>").attr("value", value).text(key));
  });

it should still fix some issue The point of using promises is to allow you to separate callbacks from the original operation (by returning a promise), and to chain multiple asynchronous operations.
You need to move your code into the promise callback:
code :
checkStock(productId)
    .then(function(result) {
        if (result > 5) {
            ...
        }
    });

I hope this helps . I was calling this Ajax request on a button click, but I had forgotten to return on that click event. I found this solutions here
solution 1: you can return false on click() function
code :
return false ; // for onClick funciton
e.preventDefault(); // e is the onclick event parameter
