To fix the issue you can do It seems the client computer (running visual studio) should be in the same network to be able to communicate with Test Controller server(in our case it should have a valid IP).

With these it helps It doesn't work.
While my scenario WAS in TFS Lab Mgmt, I found the problem really didn't relate to lab mgmt, but instead in the fact the the Moles installer looks for registry keys just don't exist when you only install the remote Test Agent without VS 2010 installed. See the following question for my Question & Answer:
Visual Studio 2010/2012 - Exceptions occur for Test Agent service when running automated test cases on remote machine

hop of those help? Per my comment under the first question, and to Andrew's answer, I discovered that the 2012 agent and controller can't be used with TFS 2010.
As some additional information, I found that our company's build agent (2010) didn't have all of the class library definitions we needed to deploy our 2012 solution properly anyway.

Hope this helps First, you have to configure your controller to run with Visual Studio. So, open the Test Controller Configuration tool and check that the Register with Team Project Collection option is not selected.
Then, from visual studio (2012):

I think the issue was by ths following , In the test mix of the scenario set the tests to run in Sequential order. This will make each virtual user run all of the tests.

will be helpful for those in need I opened a issue on the mstest github page and after looking at the source code generating my warning I am seeing it looks like there is probably no work around to this. Here is the source code I was looking at in the MSTestDiscover.cs.
code :
    // Scenarios that include testsettings or forcing a run via the legacy adapter are currently not supported in MSTestAdapter.
    if (MSTestSettings.IsLegacyScenario(logger))
    {
        return;
    }
